My husband applied for his pension on ill health grounds - this was refused without ever being medically assessed and he was eventually dismissed but after appealing and taking it to the ombudsman stage the Company agreed to have him medically assessed as apparently they should never have denied him access to this, he has now been assessed and granted Tier 1 benefit which is to be backdated also to active membership.

I am currently disputing the year they are basing his pension benefit on as it is not a great year although this is a year where he was put onto a basic salary with no bonuses awarded.  I did request that any award was based on the best 3 consecutive years during the last 10 years as prior to his illness his gross wage was amost a 3rd more than the year they have selected to base the award on.

The Scheme adminstration have referred this to the compliance team but i am wondering if anyone could advise me as to whether the bonus should be used in calculating the previous years pay - The payments were deducted as a % from his gross pay which included the bonus earned and not just as a % of the basic pay.

Any information would be greatly appreciated.
